Outline

The Reiwa Tenancy Application Form is a crucial document for those looking to enter into a residential tenancy agreement in Western Australia, and it serves multiple purposes both for the lessor and the prospective tenant. Approved and copyrighted by the Real Estate Institute of Western Australia (REIWA) in 2013, this form not only gathers detailed information from applicants, such as personal details, tenancy requirements, and financial commitments but also outlines the procedure and conditions involved in applying for a rental property. It explains the use of residential tenancy databases by lessors or property managers, detailing how an applicant's history might be checked. The application form clarifies financial obligations upfront, specifying amounts for security and pet bonds, and the initial rent payment, thereby ensuring applicants are fully informed of the costs involved before taking possession of the premises. It also provides a summary of subsequent steps if an application is successful, emphasizing the importance of compliance with the terms to establish a binding tenancy agreement. In highlighting the legal and procedural steps for entering into a tenancy, the Reiwa Tenancy Application Form plays an essential role in facilitating a transparent, fair, and structured approach to residential leasing in Western Australia.

EXPLANATION FOR APPLICANTS

Only complete this APPLICATION if You are sure that You want to enter into a Residential Tenancy Agreement with the Lessor of the Premises

The Lessor of the Premises is attempting to locate the most suitable tenant; that is a tenant who pays the rent on time and takes good care of the Premises.

To enable the Lessor of the Premises to determine in their opinion, who is the most suitable person, the Lessor's Property Manager requires some background information about You.

The form "APPLICATION TO ENTER INTO RESIDENTIAL TENANCY AGREEMENT" is not the Residential Tenancy Agreement.

The purpose of this form is:

First, to inform the Lessor of Your details, and Your requirements for the Residential Tenancy Agreement; for example, if You wish to have pets at the Premises.

Second, to inform You of the Lessor's or Property Manager's usual use of one or more residential tenancy databases.

Third, to inform You of the money that is required to be paid prior to taking possession of the Premises; for example, the value of the Security Bond (which may be up to 4 weeks rent), the Pet Bond (which can be up to $260) and the initial Rent payment (which can be 2 weeks rent in advance).

Fourth, to make You aware of the terms of the Residential Tenancy Agreement (including special conditions) associated with the Lease if Your Application is accepted.

How to Fill Out Reiwa Tenancy Application

Filling out the Reiwa Tenancy Application is a crucial step in your journey towards securing a rental property. This form is designed to provide the landlord or property manager with your personal details, rental history, and specific requirements for the property. Completing this form accurately and thoroughly increases your chances of being selected as the tenant. Here are the steps you need to follow:

  1. Gather all required information before you start: This includes your personal details, current and previous addresses, employment information, references, and any details regarding pets or special conditions you want to request.
  2. Enter the Premises Address at the top of the form to identify the property you're applying for.
  3. List the names of all Proposed Tenants who will be living in the property under the "FROM" section.
  4. Find the section labeled PART A, which is to be completed by the Property Manager, and ensure that all details including the rent per week, option fee (if applicable), and required money (security bond, pet bond, first two weeks rent) are filled in.
  5. Proceed to PART B, which you need to complete:
    • Specify the tenancy period you are applying for in months and the rent amount per week.
    • Indicate the total number of people who will occupy the premises, including adults and children, along with their ages.
    • For applicants with pets, provide details about the type and breed of each pet.
    • Answer whether you intend to apply for a residential tenancy bond from a State Government Department and, if so, provide the amount and branch details.
    • Fill in your bank account details for the refund of the Option Fee, if applicable.
    • List any special conditions you request for your tenancy.
    • Provide the address where you wish to receive the Residential Tenancy Agreement and/or notices related to the tenancy.
  6. Review the declarations in PART B regarding your bankruptcy status, the accuracy of the information provided, your acceptance of the premises' condition upon inspection, and your acknowledgement of the application process.
  7. Sign the application to indicate your agreement with the stated terms and your sincere intention to lease the premises.
  8. If an Option Fee is applicable as mentioned in PART A, arrange payment as directed by the Property Manager or Lessor.
  9. Submit the completed application along with the Option Fee (if required) to the Property Manager.

After submission, if you are not selected as the tenant and have paid an Option Fee, it will be refunded to you within 7 days. If you are the successful applicant, the next steps involve reviewing and signing the proposed Residential Tenancy Agreement provided by the Lessor, complying with the terms for the creation of a binding agreement, and fulfilling any financial obligations such as paying the stipulated rental and bonds. It's important to understand that not meeting these prerequisites can result in the Residential Tenancy Agreement not being established, and any paid Option Fee may be forfeited.

More About Reiwa Tenancy Application

  1. What is the purpose of the Reiwa Tenancy Application form?

The Reiwa Tenancy Application form serves multiple purposes. Initially, it acts as a formal method to introduce a potential tenant to the lessor, detailing the applicant's personal information and their specific requirements for the tenancy, including pet ownership. Further, it informs the applicant about the use of tenancy databases by the lessor or property manager, outlines the financial obligations needed before taking possession of the premises, and explains the terms of the Residential Tenancy Agreement the applicant will be entering into if successful. Essentially, it is a crucial step in the vetting process to determine the most suitable tenant for the property.

  2. What happens after I submit the Reiwa Tenancy Application form?

Upon submission, the application undergoes a review process where the lessor attempts to identify the most suitable tenant based on the information provided. If your application is not successful and you've paid an option fee, you will receive a refund within 7 days of the decision. Conversely, if your application is accepted, the lessor will provide a proposed Residential Tenancy Agreement granting the option to enter into a binding lease. To finalize the tenancy, compliance with all requirements set out in the Agreement is necessary, including financial obligations and document submission.

  3. Is the Reiwa Tenancy Application form the same as the Residential Tenancy Agreement?

No, the Reiwa Tenancy Application form is not the Residential Tenancy Agreement. Instead, it's a preliminary document used to collect information from the applicant and to inform them of the process and requirements for entering into a Tenancy Agreement. Only after the application is approved, and all prerequisites are met, does the completed and signed Tenancy Agreement become legally binding.

  4. What information do I need to provide in the application?

In the application, you are required to provide personal details, intended tenancy period, rent offer, details about occupants including pets, any application for tenancy bond from a government department, your bank account details for the refund of the option fee (if applicable), any special conditions you're requesting, and your contact information for receiving the Tenancy Agreement or related notices. You also need to declare your financial status and confirm the accuracy of the information provided.

  5. What is an Option Fee, and when do I get it back?

An Option Fee is a sum that may be required by the property manager at the time you submit your tenancy application. It's a kind of holding deposit. If your application is not successful, this fee will be refunded to you via electronic transfer to the bank account details you provided, within 7 days of the decision. If you are successful, the fee can be refunded or applied towards your rent.

  6. Can I apply with pets, and what about a Pet Bond?

Yes, you can apply to rent with pets. The application form allows you to specify the type and breed of your pets. If accepted, you may be required to pay a Pet Bond in addition to the Security Bond to cover any potential damages caused by the pet. The maximum Pet Bond amount is specified in the application and is intended to assist in covering costs associated with fumigation at the end of the tenancy.

  7. What if I have special conditions for my tenancy?

You can request special conditions in your Reiwa Tenancy Application. However, it's crucial to understand that the lessor is not obligated to agree to these conditions. Any special conditions that the lessor agrees to will be detailed in the Residential Tenancy Agreement. It’s advisable to clearly outline any such conditions in your application to ensure they are considered during the application process.

  8. How is my personal information used in the application process?

Your personal information is collected to verify your identity, process and evaluate your application, and if successful, manage the tenancy. It may be disclosed to relevant parties such as referees, other property managers, and tenancy database operators as part of this process. This information is handled in accordance with privacy laws, and you have the right to access and correct any personal information held by the lessor or property manager.

Common mistakes

  1. Failing to read the Reiwa Tenancy Application form instructions carefully can lead to misunderstandings about the application's requirements and processes. This results in incomplete or incorrect submissions.

  2. Overlooking the need to confirm interest in the premises before applying is a common mistake. Applicants sometimes fail to ensure the premises meet their needs, leading to potential issues after the tenancy starts.

  3. Not providing detailed information about the number of occupants or pets planning to reside in the premises can cause future disputes. Full disclosure ensures appropriate arrangements are made.

  4. Applicants often underestimate the importance of accurately detailing their rental history. Suspicious or incomplete rental history details may raise red flags for property managers.

  5. Forgetting to include bank account details for the refund of the Option Fee, if applicable, delays the refund process, especially in cases where the applicant is not successful.

  6. Ignoring the section on special conditions requested by the applicant means missing the opportunity to negotiate terms that might be crucial for their living situation, such as modifications for accessibility or specific lease terms.

  7. Misunderstanding the financial commitments required upon entering into the tenancy agreement, including security and pet bonds, leads to inadequate preparation for the associated costs.

  8. Failure to review and correct personal information before submission results in errors that could affect the application’s credibility and, ultimately, the chance to secure the tenancy.

Common pitfalls include:

  • Overlooking the declaration section where applicants must assert the accuracy of the information provided and their financial capability to uphold the lease agreement.
  • Neglecting to provide alternate contact details, which may hinder communication between the property manager and the applicant, delaying the application process or leading to missed opportunities.
  • Ignoring to check or correct personal information on the form can lead to the rejection of the application due to inaccuracies or missing details.
  • Missing the guidance on how to handle the option fee correctly could result in financial loss, especially if not familiar with the refund process for unsuccessful applicants.

Documents used along the form

When applying for a rental property using the Reiwa Tenancy Application, several other documents and forms are often required to complete the application process. These documents are crucial for landlords and property managers to assess the suitability of prospective tenants.

  • Rental History Reports: This document provides a detailed look at the applicant's rental background, including previous rentals, payment history, and any breaches or evictions. It helps property managers understand the tenant's reliability and compatibility with their leasing requirements.
  • Proof of Income: To ensure the applicant can afford the rental property, proof of income is needed. This could include recent pay stubs, bank statements, or tax returns. This document reassures the property manager of the applicant's financial stability.
  • References: References, both personal and from previous landlords, offer insight into the applicant's character and tenancy behavior. They can highlight the applicant's responsibility, behavior, and ability to maintain a rental property.
  • Photo Identification: A government-issued identification, such as a driver's license or passport, confirms the applicant's identity. This step is essential for security purposes and to prevent fraud.

Together, these documents complement the Reiwa Tenancy Application form, providing a comprehensive profile of the prospective tenant. This thorough approach aids property managers in making informed decisions, ultimately leading to a successful leasing agreement for both parties.

Similar forms

  • Rental Application for Commercial Lease: Similar to the Reiwa Tenancy Application form, this document collects data from a prospective tenant wanting to lease commercial property. Both forms serve to give the property manager or owner a comprehensive view of the applicant's background to determine their suitability for the tenancy.

  • Lease Guarantor Form: This form, often filled out alongside a tenancy application, requires information about a guarantor who will be responsible if the tenant fails to meet the lease obligations. Like the Reiwa form, it collects detailed personal information to assess financial reliability, albeit about the guarantor rather than the tenant.

  • Credit Check Authorization Form: Similar in its function of vetting potential tenants, this form authorizes the landlord or property manager to obtain a credit report on the applicant. The Reiwa Tenancy Application indirectly performs a similar vetting process by gathering information that may impact the lessor's decision.

  • Security Deposit Receipt: This document is issued after the initial stages of a tenancy application are approved and the security deposit is collected, akin to the Reiwa form specifying the security bond amount required if the application proceeds.

  • Pre-Tenancy Application Form: This form, used before entering into a detailed tenancy agreement, collects basic information about the potential tenant. Its purpose aligns closely with the Reiwa form's intent to screen applicants before granting them the lease.

  • Pet Agreement Addendum: This is an additional document to a standard lease agreement that outlines terms for keeping pets on the property. The Reiwa form inquires about pets early in the application process, highlighting the importance of pet-related information in residential tenancies.

  • Property Inspection Report: Although used after a tenant moves in, this report is crucial for documenting the property's condition, similar to how the Reiwa Application asks tenants to acknowledge the state of the premises upon inspection.

  • Notice of Rent Increase: This notice is similar to parts of the Reiwa form that deal with future expectations—such as rent amounts—by formalizing changes in the terms of the tenancy, emphasizing clear communication between lessors and tenants.

  • Tenant Reference Check Form: This document is used by landlords to request information about potential tenants from previous landlords or references. Like the Reiwa form, it's a tool for assessing an applicant’s suitability for tenancy based on past behavior.

  • Move-In/Move-Out Checklist: This checklist documents the condition of the property at both the beginning and end of the tenancy. It complements the Reiwa application's goal of ensuring both parties agree on the premises' condition, safeguarding the interests of the lessor and the tenant.

Dos and Don'ts

When filling out the Reiwa Tenancy Application form, there are important steps and precautions to consider for a successful application process. Below are lists of things you should and shouldn't do.

What you should do:

  1. Ensure you have inspected the premises in person to verify its condition and suitability for your needs before applying.
  2. Provide accurate and complete information in every section of the application to avoid delays or rejections.
  3. Include details about any pets you intend to keep at the premises to ensure compliance with pet policies and bond requirements.
  4. If applicable, indicate your intention to apply for a residential tenancy bond from a State Government Department, as this information is crucial for the processing of your application.
  5. Review the terms regarding the Option Fee, if applicable, and ensure you understand the conditions under which it will be refunded or forfeited.

What you shouldn't do:

  1. Do not leave any sections blank. If a section does not apply, clearly mark it as N/A (Not Applicable) to demonstrate that you have reviewed and acknowledged every part of the application.
  2. Avoid providing false or misleading information, as this could lead to the rejection of your application or termination of tenancy if discovered after entering into an agreement.
  3. Do not ignore the requirement to pay the security bond, pet bond (if applicable), and the first two weeks' rent upfront, if you are the successful applicant. Failing to prepare these payments can delay or nullify the tenancy agreement.
  4. Resist the urge to submit the application without reading and understanding the terms related to the use of residential tenancy databases, as this could impact your application.
  5. Do not forget to include your bank account details for the refund of the Option Fee (if applicable), as failing to provide this information could delay any necessary refunds.

Following these guidelines can help streamline the application process and increase your chances of success in securing your preferred rental property.

Misconceptions

There are several misconceptions surrounding the Reiwa Tenancy Application form. Understanding these misconceptions can help applicants navigate their tenancy applications more effectively. Here are ten common misunderstandings:

  • The application form is legally binding. The form itself is not a Residential Tenancy Agreement and does not bind the applicant or the lessor to a tenancy agreement.
  • An option fee is always required. While the form mentions an option fee, it may not always be applicable. Its necessity and amount depend on the specific terms set by the lessor or property manager.
  • Completing the application guarantees tenancy. Submission and completion of the form do not guarantee that the applicant will be successful in securing the tenancy.
  • Personal information provided is only used for background checks. Personal information may be used for various purposes including verifying identity, evaluating the application, and managing the tenancy if the application is successful.
  • Pet bonds are mandatory for all pets. The requirement for a pet bond depends on whether pets are allowed on the premises and, if so, what kind of pet bond may be required.
  • The form must be submitted in person. While the form does not specify submission methods, many property managers accept electronic submissions as well as in-person or postal submissions.
  • Bank details are only for refunding the option fee. While bank details are needed for refunding the option fee, if applicable, they may also be used for other financial transactions related to the tenancy.
  • Applicants can propose any special conditions. While applicants can request special conditions, the lessor is not obligated to accept them.
  • If the application is unsuccessful, feedback will be provided. There is no obligation for lessors or property managers to provide feedback if an application is unsuccessful.
  • The application form is the final step in the application process. The form is a preliminary step. If successful, further steps, including signing a Residential Tenancy Agreement, are required.

It's important for applicants to read through the entire Reiwa Tenancy Application form carefully, understand the implications of submitting the application, and know what steps come next in the process. Misunderstandings can lead to confusion or false expectations, which can be avoided with a clear comprehension of the form's purposes and requirements.

Key takeaways

Understanding the Reiwa Tenancy Application form is crucial for anyone looking to rent a property. Here are seven key takeaways that will help guide you through the process:

  • Completing the Application: Only fill out the Reiwa Tenancy Application form if you're committed to entering into a Residential Tenancy Agreement for the specified premises.
  • Lessor's Selection Process: The property owner or their agent uses the application to decide on the most suitable tenant, considering factors like timely rent payment and property maintenance.
  • Application Is Not an Agreement: It's important to know that this form is not the actual Residential Tenancy Agreement. Its purpose is to provide your details and requirements to the lessor.
  • Financial Requirements: Be prepared to discuss financial commitments such as the security bond, pet bond (if applicable), and the first two weeks of rent in advance.
  • Option Fee: If an option fee is required, it must be paid when you submit your application. This fee will be refunded if you're not selected as the tenant.
  • Signing the Agreement: If you are the chosen applicant, the lessor will offer you a proposed Residential Tenancy Agreement. A binding agreement is established once you sign and meet all stipulated conditions, even if an option fee was not involved.
  • Understanding Your Obligations: Failing to comply with the prerequisites for establishing a binding Residential Tenancy Agreement results in the forfeiture of any option fee paid and may lead to the landlord selecting another tenant.

This information aims to simplify the application process and underline the significance of each step involved in securing a rental property. Remember, thorough preparation and understanding of your obligations can make the renting experience smoother for both you and the lessor.
